Privacy Policy

  1. Introduction and Scope
    1. Kangarootime is committed to protecting your privacy and complying with its obligations under the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APP) in respect of that information. If you are located in another jurisdiction, additional local requirements will apply. 
    1. This Privacy Policy explains how and why Kangarootime collects your personal information, how we use it and what controls you have over our use of it. Please read this policy carefully.
    1. By using our website or mobile applications (Application) or otherwise interacting with us, you consent to us using your child’s (where applicable) and your personal information as outlined in this policy. Your use of any part of our Application will constitute your consent to the collection, transfer, processing, storage, disclosure and other uses of your personal information in accordance with this Privacy Policy. If you do not agree with the terms and conditions of this Privacy Policy, please do not access or use our Application or services. 
    1. In this Privacy Policy, ‘us’ ‘we’, ‘our’ or “Kangarootime” means Kangarootime Australia Pty Ltd ACN 643 258 673 and each of their associated entities as appropriate. 
  2. Types of personal information we collect 
    1. The personal information that we collect and hold about you depends on your interaction with us.
    1. We collect and hold various types of personal information in connection with your use of the Application, including: 
      1. contact and demographic details such as your name, gender, address, phone number and email address when you sign up for an account or transmit content via the Application; 
      1. additional specific information about your child which is necessary for the provision of services, including their name, gender, date of birth, Medicare number, custody arrangements or parenting orders, dietary requirements, languages spoken, doctor’s details, medical conditions and additional needs; 
      1. photographs and videos of children which are transmitted via the Application; 
      1. financial and transaction data including billing and credit card details and information about payments made via our secure online payment portal on the Application; 
      1. usage data including information about how you use our Application; 
      1. technical data including your internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access the Application; 
      1. marketing and communications data including your preferences in receiving marketing from us and your communication preferences; and 
      1. information necessary for or incidental to the provision of our services on the Application. 
  3. Sensitive information ‍
    1. “Sensitive Information” is defined in section 6 of the Privacy Act, and includes (amongst other things) information about an individual’s:-
      1. racial or ethnic origin;
      1. religious and philosophical beliefs and political affiliations;
      1. sexual orientation and practises;
      1. criminal record;
      1. health status; and
      1. biometrics.
    1. Kangarootime will from time to time, collect sensitive health information from your child when your child enrols in a childcare centre for the express purpose of complying with regulatory requirements and only where the collection of such sensitive information is reasonably necessary for, or directly related to, the ongoing operation of the Application or the provision of the Services.
    1. We will ensure this information is stored securely within the Application and in accordance with the Privacy Act.
    1. Kangarootime will only collect other sensitive information, such as information relating to you and your child’s racial or ethnic origin, or any cultural or religious requirements, with your consent and will ensure that it is only used for the purpose for which it was provided, and all times strictly in accordance with the Privacy Act. 
  4. How we collect your personal information 
    1. We may collect personal information from you or your child (where applicable) directly when you: 
      1. provide us with such information when you register for an account on the Application; 
      1. share, upload and receive content on the Application;
      1. otherwise interact with our Application and content; and/or
      1. otherwise provide us with such information upon our request.
    1. When you use our Applications, some personal information is collected automatically about you.  For example, when you visit our websites, our web servers automatically log:
      1. including your device’s operating system, Internet Protocol (IP) address, browser type and language, and device type.
      1. such as city, state, country, and jurisdiction, or precise geolocation, depending on your device or app settings.
      1. such as the website you visited before our websites or apps, access times, and your activity on our websites.
    1. In some circumstances we may also collect personal information from third parties, such as the childcare centre that your child attends, or otherwise with your prior consent.  Other third-party sources of personal information may include:-
      1. social media platforms or other social platforms you choose to use to connect with us;
      1. data brokers; and/or
      1. publicly available sources, such as Government databases;
    1. Kangarootime may also collect your information when you:
      1. visit and/or register on any of our websites;
      1. use our services or software;
      1. post to our Forum, blogs or on any of our social media platforms including; and
      1. contact our support team.
    1. Kangarootime will not ask you for any personal information which we do not need. The Privacy Act requires that we should collect information for a purpose that is reasonably necessary for, or directly related to our activities and operations.
  5. Use of your personal information
    1. We will generally use, hold and store your personal information if it is reasonably necessary for or directly related to the performance of our functions and activities and for the purposes of: 
      1. enabling access and use of our Application; 
      1. communicating with you about your use of the Application; 
      1. facilitating interactions with you in the course of operating our business; 
      1. providing information on companies and businesses, including details of their employees, as part of our Services; 
      1. to administer the Application, including troubleshooting, data analysis, testing, system maintenance, support, and reporting and hosting of data;
      1. payment processing;
      1. marketing (including communicating directly with you about offers, promotions, new services and features);
      1. improving, updating and personalising the Application and the Services;
      1. cooperating with public and Government authorities and courts and regulators in compliance with our legal obligations under all applicable laws.
      1. providing direct market offers for products and services provided by or on behalf of Kangarootime (or any other third-party), which Kangarootime considers to be of interest to its customers.
      1. for any other purposes for which you have consented from time to time. 
  6. Disclosure of personal information
    1. Kangarootime will only disclose your personal information for the purpose it was collected or a reasonably expected or related secondary purpose. We may disclose personal information about you or your child: 
      1. to third party service providers, who assist us in operating our business (including credit reporting bodies, collection agencies, data protection and cyber security agencies, legal advisors and technology service providers);
      1. to our banks or financial institutions for the purposes of payment processing;
      1. as part of a corporate transaction, such as financing, mergers, obtaining insurance or the acquisition or divestiture of assets;
      1. to our professional advisers (including lawyers, bankers, accountants, auditors and insurers who provide services to us in respect of the Application or the Services;
      1. to comply with a law, regulation, legal process, or governmental request; to assert legal rights or defend against legal claims; or to prevent, detect, or investigate illegal activity, fraud, abuse, violations of our terms, or threats to the security of the Application or the physical safety of any person.  Kangarootime will not otherwise disclose personal information to a third party for any other purpose without your consent unless it is authorised or required by law. 
  7. Quality, accuracy, and integrity of any information 
    1. You are responsible for the quality, accuracy, and integrity of any information provided in your account details or profile or use of the Application.
    1. If any personal information you provide to us is incomplete or inaccurate, we may be unable to provide you with the services you are seeking.
    1. You can update your client personal information at any time by logging onto the Application and editing your account information and profile, and may request updates to any of your publicly available personal information by contacting our privacy officer using the details set out at the end of this policy.
    1. We may still however store previously recorded data in archive for record keeping, security and audit purposes.
  8. Security of your personal information 
    1. Kangarootime is committed to protecting the security of your personal information. We use a variety of security technologies and procedures to help protect your client personal information from unauthorised access, use, or disclosure. We store the client personal information on computer systems with limited access that are located inside our controlled facilities.
    1. Whilst we adopt all protections over client personal information within our control, we cannot guarantee the security of information transmitted via the internet. As such, transmission of any client personal information via the internet is at your own risk and we cannot be held responsible for the security of such information. All data is securely stored in data centres located in Australia.
    1. Kangarootime confirms that, in line with its obligations under the Notifiable Data Breaches Scheme published by the Office of the Australian Information Commissioner, it has procedures in place should the confidentiality or security of your personal information be compromised. We confirm that we will advise you at the first reasonable opportunity following discovery of a security breach that is likely to cause serious harm, where your information is lost, stolen, accessed, used, disclosed, copied, modified or disposed of by an unauthorised person or in any unauthorised manner.
  9. Direct Marketing 
    1. If you have provided personal information to us, we will only send you direct marketing communications and information via mail, or email with your consent. 
    1. If you do not provide your consent to receive direct marketing communications, you may opt-out of receiving marketing communications from us by contacting us at the details below or by using opt-out facilities provided in our communications. We do not provide client personal information to other organisations for the purposes of their direct marketing and will not sell, rent or lease our customer lists to third parties. 
  10. Overseas disclosure
    1. It is unlikely that we will need to disclose client personal information to an overseas recipient or otherwise store client personal information overseas. If we are ever required to do so, we will obtain your informed consent or ensure that the overseas recipients comply with APP 8.
  11. Use of Cookies 
    1. To improve your experience on our Application, we may use ‘cookies’: small data files that are served by our website and stored on your device. These are used by us or third parties for a variety of purposes including to operate and personalise the website.
    1. Cookies may be used for recording preferences, conducting internal analytics, conducting research to improve our offering, assisting with marketing and delivering certain website functionality. You may refuse to accept cookies by selecting the appropriate setting on your internet browser. However, please note that if you do this, you may not be able to use the full functionality of our website. 
  12. Third party sites 
    1. For your convenience and to improve the usage of the Application we may insert links to or utilise the services of third-party websites and applications, for which this Privacy Policy does not apply. Kangarootime is not responsible for those third party websites, applications or resources. If you access such websites, applications or resources, you do so at your own risk and we make no representations or warranties regarding third parties’ privacy practices. 
    1. We encourage you to read the privacy statements/policies of every website, application or resource you use. When we do link to a third party website, application or resource, this does not automatically imply that Kangarootime endorses that website, application, resource and their contents. Our Privacy Policy does not cover the use of cookies by any third parties. 
  13. Data Retention 
    1. We will only retain your personal information for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal information for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you. 
    1. Where we anonymise your personal information (so that it can no longer be associated with you) for research or statistical purposes, we may use this information indefinitely without further notice to you. 
  14. Accessing or correcting your Personal Information 
    1. We are committed to maintaining accurate, timely, relevant and appropriate information. Where requested, we will provide you with a copy of the personal information that we hold which relates to you, provided that the request is made in accordance with the APPs (contained in the Privacy Act). We will also update any inaccurate information about you if you inform us that the information is inaccurate, out of date, incomplete, irrelevant or misleading.
    1. There are no charges for requesting access to or the correction of your personal information, however if the volume of information we hold is excessively large, we reserve our rights to charge you any reasonable administration fees (including fees for photocopying) associated with your request.   1. We will respond to those requests within 30 days in accordance with our obligations under the Privacy Act. If we refuse a request to access or correct personal information, where reasonable, we will provide you our reasons for doing so and information about your ability to complain about such refusal.
    1. In order to protect the confidentiality of your personal information, details of your information will only ever be passed on to you where we are satisfied that the information relates to you. Accordingly, we may request documentation from you which confirms your identity before passing on any personal information which relates to you. 
  2. Changes to this Privacy Policy
    1. Kangarootime will occasionally update this Privacy Policy. Kangarootime encourages you to periodically review this Privacy Policy to be informed of how Kangarootime is using, collecting, protecting and disclosing your personal information. 
  3. Complaints
    1. Kangarootime takes privacy and its obligations under the Privacy Act very seriously. If you have complaints or concerns regarding potential breaches of the APP by Kangarootime or its contractors, you can make a complaint. Complaints must firstly be made to help@Kangarootime.com.au.
    1. We will review and respond to complaints in good faith within 14 days. If you remain dissatisfied and are concerned that we have not complied with your legal rights or applicable privacy laws, you may a formal complaint directly to the Office of the Australian Information Commissioner (OAIC) using the webform available on their website:-
